www.kropki3.pl regulations

 

I love what I do. I have a small studio, I am not a big manufacturer. My desire is to design and produce items which meet highest quality and accuracy standards. This is also the reason why all my designs are made from genuine leather.

 

I General conditions

1.These Regulations specify the rules governing placing the orders as well as purchasing the goods via the online store www.kropki3.pl, which is owned by Studio Kropki3, with its registered office in Rumia (postal code 84-230), at Podmokła 2.

2.The provisions of these Regulations shall be subject to all the contracts and services which are being provided through an online store www.kropki3.pl, as well as all the contracts and services provided by Studio Kropki3 within the framework of activities carried out on the internet platform pl.dawanda.com.

  1. Each Buyer is obliged to familiarize himself with the content of these Regulations, before he starts to use the services provided by this online store.

 

II Presentation of the goods

1.The store www.kropki3.pl has made every effort to make sure, that the published data and pieces of information are error-free and devoid of shortcomings. The invalid data however cannot be treated and used as the basis for any claims.

2.In the case of non-conformity with the description of the product placed on the website and/or the photograph, and if the product is damaged, the Buyer is asked to immediately inform the store service www.kropki3.pl.

3.All the prices which are placed on the website of the store already include VAT.

4.The price of each product is valid at the time of placing the order by the Buyer. We reserve the right to change the prices of the offered goods on the store’s website as well as the right to change the products’ descriptions at any time.

5.We reserve the right to carry out and cancel all kinds of promotional campaigns and sales at any time.

6.The dimensions which are presented in the descriptions of the products contain the indicative data which may slightly vary depending on the cut, the model and the particular copy of the selected item.

7.The shade of the product received by the Buyer may slightly differ when compared to the shade / colour presented in the photographs posted on the website of the Seller. This is a consequence of the usage of high quality raw materials of natural origin in the production process.

  2. All the text information and the images/photographs of the products which are posted on the Seller’s website are protected by the copyright. It is forbidden to copy them, distribute, use for any commercial purposes and to present them on other websites without our written consent.
  3. All the trademarks and trade names are used solely for the purposes of presentation of the products and are the property of Studio Kropki3.

 

III Registration of the customers

1.Placing an order is performed by filling out the form located at the store’s website.

2.Registration can be made by the individuals who are over 18 years old or by the minors who have obtained a written consent of their legal guardians, as well as the legal persons.

3.If a minor or an individual who does not have a full legal capacity wishes to purchase the product, the Seller will proceed to perform the contract after having received a written consent of the legal guardian of a minor or a person lacking a full legal capacity to purchase the selected item. The consents should be sent by an e-mail: studio @ kropki3.pl

4.During the registration process, you must provide correct and true information, or otherwise the order may not be executed.

5.Personal data of our customers are collected and processed exclusively for the needs and purposes of executing the orders made on the store’s website, and also to conduct various promotional and advertising campaigns according to the requirements on protection of personal data set forth in the Act of 29 August 1997 (Journal of Laws of 2015. Pos. 2135,2281) on the protection of personal data.

6.The administrator of personal data within the meaning set forth in the Act of 29 August 1997 (Journal of Laws of 2015 Pos. 2135,2281) on the protection of personal data is Studio Kropki3, with its registered office in Rumia ( postal code 84-230) at Podmokła 2 Street, and is entitled to process the personal data of the customers in accordance with the provisions of the Act of 18 July 2002. (Journal of Laws of 2015. Pos. 1844) on the provision of electronic services.

 

IV How to place an order

  1. Orders are accepted only electronically using the website www.kropki3.pl 7 days a week, 24 hours a day.

2.Orders are executed in the business days from 8:30 a.m. until 4:30 p.m.

3.Business days are considered days from Monday to Friday, excluding public holidays.

4.After having placed an order by filing out a form on the website, the Buyer receives a reply message containing information about the acceptance of the contract and the data needed for a bank transfer on an e-mail address of his choice (in case the Buyer chose the bank transfer as a method of payment).

5.Transfer of funds to pay for the goods selected by the Buyer is presumed as equivalent to signing a contract of sale with the shop www.kropki3.pl

V Methods of payment

1.Customers making a purchase in the store www.kropki3.pl agree to receive a sales document without their signature.

2.A standard proof of purchase is a bill issued by a Seller.

3.Acceptable methods of payment for the ordered goods in the store are:

1) bank transfer to the account specified by the Seller in a return mail;

2)payment for the ordered goods at its reception in cash into the hands of the postman / courier, the so-called “cash on delivery”.

4.If a Buyer selects the first method of payment, he is obliged to transfer the amount of funds covering the price of the goods and the costs of its delivery to the account number indicated by the Seller within 7 days from placing an order. In the case of non-payment, the order will be cancelled without prior notice to the customer.

 

VI Execution of the customer’s order

1.If the Buyer chooses a bank transfer as a payment method, the order will be executed only when the bank transfer in a proper amount is BOOKED at the Seller’s bank account. If the transfer is not executed and booked, a contract of sale is deemed to be void and the order will not be processed.

2.Execution of the customer’s order takes place within 7 business days from the date of booking a payment on the Seller’s account.

3.In case the Buyer chooses a payment for the ordered goods at its reception in cash into the hands of the postman / courier, the so-called “cash on delivery” as a payment method, the order will be executed within 7 business days of placing an order on the website.

4.The store www.kropki3.pl reserves the right to refuse to execute an order in case of errors on the shop’s website, involving the wrong information about the prices or condition of the goods, as well as in situations of justified doubt as to the authenticity of the data provided by the customer during the registration or ordering process.

5.In the case of the occurance of the circumstances preventing the execution of the order, the shop reserves the right to withhold its execution. In such case, the customer will be notified about the situation immediately.

6.The store www.kropki3.pl asks all customers to ACCURATELY ENTER YOUR DATA, GIVE EXACT ADDRESS, POSTAL CODE AND CITY.

7.By placing an order the customer agrees to the usage and processing of his personal data by the service provider of the delivery.

 

VII Return of the ordered goods

1.Pursuant to the Act of 30 May 2014 (Journal of Laws of 2015. Pos. 1854) on the consumer rights, the Buyer may withdraw from the contract concluded at a distance or away from the business premises without giving any reason within 14 days from the date of delivery. Return of the goods does not apply to copies made to meet the individual needs of the Buyer.

2.The costs of shipping back (return) of the goods shall be borne by the Buyer to the extent specified in the provisions of article 27, 33, 34 paragraphs 2 and 35 of the Polish Statute on consumer rights.

3.The returned goods cannot bear any traces of use, should have the factory packaging and the labels.

4.The remittance for the returned goods will be paid to the Buyer by the bank transfer to the bank account indicated by him within 7 business days from the date of receipt of the returned goods by the store www.kropki3.pl.

5.The withdrawal form will be attached to the consignment.

7.We do not accept parcels sent at the expense of the recipient or using the “cash on delivery” method.

 

VIII The warranty and complaints

1.All goods available in the store are covered by 24 months long manufacturer’s warranty.

2.The warranty does not cover any kind of accidental or intentional mechanical damage (tears, cuts, scratches, wipe the shell fittings, etc.) or any damage caused by negligent or improper use of the goods by the Buyer.

3.The basis of the complaint is delivery of the proof of purchase (bill).

4.Each defective good should be sent with an attached document of the complaint or a statement of complaint containing a described cause of the complaint as well as the date and description of the circumstances in which the defect occurred. The Buyer should also provide the Seller with his name, address, order number, and present his requests (eg. repair of the defective goods).

5.The complaint will be dealt with within 14 days of the receipt of the defective goods along with the necessary documents listed in points 3 and 4 by the Seller, and the customer will be informed of the outcome of the complaint procedure.

6.The costs of shipping goods related to the use by the Buyer of the complaint procedures shall be borne by the Seller, indicating however that the Seller is obliged to reimburse the Buyer to pay the lowest possible costs of shipping the goods which were subject to complaint procedures, and this means that the Seller will reimburse the Buyer to pay the costs of shipping according to the price list for national universal services of the Polish Post.

7.In the case of shipping the goods which were subject to complaint procedure using  a different provider of postal services than the Polish Post (on a special client’s request), the Seller will not cover the costs of shipping those goods according to the rates of a given entity, but according to the price list for national universal services of the Polish Post. The difference in the price of shipment in such scenario will be covered by the Buyer by transferring the appropriate amount of money to the bank account indicated by the Seller.

8.In the case of a justified complaint, the defective product will be repaired, but if this turned out to be impossible, it will be replaced by a sterling one, but if this would also become impossible (for example, due to exhaustion of stocks), the Seller will return the money to the Buyer or offer him a different product of the equivalent value of his choice.

9.In the case of an unjustified complaint, the goods will be sent back to the Buyer using the cheapest possible way at the expense of the Seller. If the Buyer however wants the defective goods to be sent via courier or a priority shipment by Polish Post, the difference in the price of shipment will be covered by the Buyer by transferring the appropriate amount of money to the bank account indicated by the Seller.

 

IX Shipping/delivery

1.The costs of shipping the goods are covered by the Buyer.

2.Shipments in the territory of Poland are carried out by the Polish Post. Shipping cost will be added to the price of the bag and amounts to 16 PLN (polish zloty).

3.The shop www.kropki3.pl executes the orders to the countries outside of Poland also, as long as the country is in the European Union. In such cases, the details concerning shipping of the goods are determined via e-mail or by telephone.

4.The cost of delivery to the EU countries amounts to approximately 17 euros. This cost will be added to price of the handbag and covered by the Buyer.

5.The orders to the countries other than Poland are sent via courier DHL, UPS, DPD or the Polish Post. The method of shipment is determined by the Seller.

6.The maximum delivery time is 14 business days, counted from the date of booking the payment on the bank account indicated by the Seller.

7.Packages are delivered only on business days.

8.If the Buyer receives a package which is damaged or it seems like the third parties might have interfered with the content, the Buyer should refuse to accept the package and draw up a protocol of reporting the damage in the presence of the mailman/ courier. The Buyer should also notify the Seller if such a situation occurs.

 

X Final provisions

1.Special offers and discounts in the store www.kropki3.pl cannot be combined, unless it is specified otherwise in the rules of the promotion.

2.In the situations not regulated by these Regulations, the provisions of the Civil Code and the Act of 30 May 2014 (Journal of Laws of 2015 pos. 1854) on the rights of the consumers should apply.

3.The competent court for any disputes which may arise from the contract of sale is the court competent for the defendant.
